Processing Purposes and Legal Basis

Your data is processed for the purpose of debt management in accordance with Article 6 (1) lit. f GDPR. Our legitimate interests are the purchase of receivables, their administration as well as mandating collection agencies to collect these receivables. Your data is also processed for the purpose of compliance with legal and regulatory obligations applicable, e.g. applicable tax legislation, in accordance with Article 6 (1) lit. c GDPR.

Data Categories and Data Sources

We process the following categories of data: Master data, contact data, contract data, receivables data, payment information, if applicable. Data under those categories was transmitted to us by the original creditor or one of the recipients named below.

Recipients

In the context of the debt management, we have and/or will transfer your data, if necessary, to the following categories of recipients: credit servicing companies, service providers, third-party debtors, courts, bailiffs, lawyers, debt management companies.

Duration of Storage

After full payment of the outstanding claim or termination of the collection procedure, we will check after three years whether we still need your data at least in part, for example due to legal retention periods.

Your Rights

If the legal requirements are met, you have the following rights under Articles 15 to 22 GDPR: right to information, access, correction, deletion, restriction of processing and data portability.

Furthermore, pursuant to Article 21 GDPR, you have the right to object to the processing based on Article 6 (1) lit. f GDPR.

Right to lodge a complaint with the Supervisory Authority: Pursuant to Article 77 GDPR, you have the right to lodge a complaint with a Data Protection Supervisory Authority. Purposes for processing and legal basis

In accordance with Art. 6 (1) b of the GDPR (contract performance), we process your data to administer and manage the portfolio of receivables originated by you and sold to the Company (debt purchase agreement) and exercise its rights under the transaction documents pursuant to which the Company purchased the debts and appointed others, such as Asset Managers to service these receivables.

In accordance with Art. 6 (1) c of the GDPR (legal obligation), we process your data to comply with legal and regulatory obligations applicable to the Company from time to time, including, without limitation, applicable   tax, anti-money laundering and other counter terrorist financing   legislation. 

In accordance with Art. 6 (1) f of the GDPR (legitimate interest), we process your data to maintain contact and correspondence regarding concluded contracts, tenders, negotiations and exercising procedural rights and to build and maintain business relationships/partnerships.

Data categories and data sources

We process the following categories of data: Master data, address data, communication data and contract data. The data from these categories was either supplied to us by you or acquired from publicly available data sources.

Recipients

We disclose your data to another company of the EOS Group or another third party (recipient) if:

  • there is a legal obligation for the transfer of the data in accordance with Art 6, (1) c of the GDPR,
  • it is necessary to process your data for the purposes of fulfilling a contract with you,
  • in accordance with Art. 6 (1) f of the GDPR the transfer is necessary for the assertion, exercise or defence of legal claims 
  • the data will be processed by a processor in accordance with Art. 28 of the GDPR.
Your personal data will not be passed to third parties for other purposes than those specified above.

Duration of storage

We will keep personal data of contact persons and representatives of our Business Partners, in accordance with the Company’s legal and regulatory obligations and any applicable record retention policy of the Company, otherwise only for as long as the retention of such Personal Data is deemed necessary for the purposes for which that Personal Data are Processed (as described in this privacy notice).

Rights of the data subject

In accordance with Art. 15–22 of the GDPR, you have the following rights if the legal requirements are applicable: Right of access, rectification, erasure, restriction of processing and data portability. 

You also have a right to object to processing in accordance with Art. 14 (2)(c), Art.13 (2) b and Art. 21 of the GDPR, based on Art. 6(1)(f) of the GDPR.

Information concerning the purpose of data processing and the data being processed

We process the data that you have sent us in connection with your application in order to check your suitability for the position (or other vacancies in our company, if necessary - if your consent is required by law, we will obtain it beforehand) and to carry out the application procedure. If further data are processed in the context of the current application process, we will inform you about this separately.

Legal basis for the processing

The legal basis for the processing of your personal data in this application procedure is primarily Article 6 (1) b GDPR as amended on 25 May 2018. Thereafter, the processing of data required in connection with the decision to establish a contractual relationship is permitted.
Should the data be considered necessary for legal prosecution after completion of the application procedure, data may be processed on the basis of the requirements of Art. 6 GDPR, in particular to fulfil legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR. Our interest is then in asserting or defending claims.

Duration of data storage 

Data of applicants will be deleted 12 months after the official notification of the rejection. If you have been accepted for a position during the application process, the data from the applicant data processing will be retained according to our data retention policy for employees.

Information on the recipients of the data

Your application data will be reviewed by us upon receipt of your application. In the company, only those persons have access to your data who need them for the proper handling of our application process. Within the scope of system maintenance and servicing, the persons entrusted with it may become aware of your data. The corresponding persons or service providers, if applicable, are obliged to maintain data secrecy. The data is processed in the European Union.
